A legal challenge to the FCC's white space order has been dropped. The National Association of Broadcasters yesterday asked a D.C. Circuit appeals court to dismiss its lawsuit against the commission's decision to open up the empty spectrum between television bands. The move to dismiss the suit came after the FCC issued an order addressing broadcasters’ concerns last month.

The FCC plans to vote on an order at its May 24 open meeting that will give more flexibility to companies that hold economic-area-based 800 MHz licenses. The regulations are designed to make it easier for licensees to upgrade their 2G networks to more advanced technologies. The agency will also vote on proposed rules for wireless sensors used to monitor patients, known as medical body area networks, and a notice of inquiry into deployable aerial communications architecture used during emergencies.

Barnes & Noble is pitching its light-up Nook in a new national advertising campaign. The "Read in Bed" campaign shows the glow-in-the-dark Nook allowing couples to sleep easier, since their partner can read without turning the lights on. Barnes & Noble said sales of the Nook GlowLight have been so strong that the eReader is temporarily sold out, but it expects to have more in stock soon.
