Lawsuit Aimed at T-Mobile Overtime

By Andrew Berg

The law firm of Pelton & Associates PC announced that it has filed a class and collective action lawsuit against T-Mobile USA.

The lawsuit is designed to include people who are or were employed by T-Mobile as retail sales associates and supervisors who were not paid regular wages for all hours worked or overtime wages for hours worked in excess of 40 hours per week.

The complaint asserts New York State Labor Law claims on behalf of a class of New York employees who worked for T-Mobile from July 10, 2003, to date, as well as California Wage Law claims on behalf of a class of California employees who worked for T-Mobile from July 10, 2006, to the present.

A spokeswoman for T-Mobile said: “T-Mobile is compliant with wage/hour laws, and we don’t comment on pending litigation.”

The complaint also alleges that the employees were issued T-Mobile smart devices and were required to review and respond to numerous T-Mobile-related e-mails and text messages at all hours of the day and night, whether or not they were logged into T-Mobile's computer-based timekeeping system.

Spectrum Warehousing: Were They or Weren't They?

Did SpectrumCo ever intend to build a wireless network? Or were they really planning to sit on the airwaves until they came immensely valuable?

The Absuridty of 4G Is Upon Us

Why aren’t more people complaining about the absurdity of AT&T passing off its 3 to 5 Mbps HSPA+ network as "4G," when LTE can and does hit 12, even 16 Mbps regularly?
